Use of Website(s)
The use of the website is for the general public, residential and/or commercial consumers, businesses, individuals, etc... All information contained within this and/or any of our websites owned by 123Vita, LLC is the proprietary property copyrighted by law, applicable to our business purposes and strictly, explicitly for our use only. The images contained therein are the property of 123Vita, LLC, where they have been taken from us, and/or they are the property of Blendtec, Waring, or Vita Mix, and other organizations, posted with their permission. In either case, copying any of the images and/or content in any way is a copyright violation.
Purchases
Any purchases made from 123Vita LLC will be processed through Visa, MasterCard, American Express, or Discover Card by telephone, email, or secured shopping card as available on the website(s). 123Vita, LLC promises the delivery to its customers of its orders within 5 to 10 business days from the order date and confirmation of payment clearance.
For example UPS (United States Parcel Services) will always drop the package off to our customer's front door if deemed safe. If the customer has specific shipping requests and wants to make sure that a package is for example sent by a specific carrier, he/she should call us. A fee might apply depending on whether an increased shipping cost to 123Vita, LLC might arise. We would like to handle and deal with this matter on a case-by-case situation and only by phone and email. Usually the carriers will not request a signature unless the customer specifically requests it from us.
Insurance of product shipped is usually included covering the purchase price.
Domestic Shipping
Unless specifically indicated as FREE SHIPPING on the Purchase Button Link "Buy-Now", shipping charges apply. Orders will be filled and either shipped from our own warehouse or drop-shipped from associated warehouses, distributors, and/or factories, respectively. The form of shipping method locally within the United States and/or the USA Territories, and/or USA Hawaii, USA Alaska, or Puerto Rico will all be transported/mailed or shipped the most economic way at the discretion of 123Vita, LLC.For example UPS (United States Parcel Services) will always drop the package off to our customer's front door if deemed safe. Warranty Claims
Any product warranty claims of Waring, Blendtec, Vita Mix Corporation - products need to be made at the applicable factory, except for the OMNI Blenders. 123Vita, LLC does not independently issue guarantees or warranties of any of the blender products delivered which are not specifically a 123Vita, LLC Brand (with exception to the Warranty Upgrade in the matter of the OMNI Blender). The 123Vita, LLC brand of products such as sound enclosure boxes carry a 6 months or 3 months warranty, subject to residential or commercial use.If the prospective buyer, website visitor, or actual buyer has any questions pertaining to warranty and or repair service of the subject equipment, please contact the Warranty and/or Repair office of the applicable factory.
Disclaimers
123Vita, LLC is hereby released by the shopper, browser, buyer, customer, and/or visitor from any liability/ies arising allegedly from the use, the content of this website and/or the consumption or application of equipment sold from this website, which is a third-party product. The use of tampers in blenders is solely at the discretion of its consumers. 123Vita, LLC does not claim, implied, or explicitly state, promise, suggest, or guarantee any kind of healing of illnesses, ailments, disease, injury, etc... from the use of the blenders sold and/or offered, recommended, suggested, or otherwise implied to be used over one other product.
While the suggestions made by 123Vita, LLC are based on usage tests and comparisons of blending events, it does not suggest other uses or other results in many other variable situations.
Please keep equipment out of reach of children and/or persons of alike character. It is extremely dangerous to put your hand into the container while the blender is in the "ON" position. It may result in dismemberment and/or severe injuries. Our recommendation for consideration and at the discretion of the user are goggles, and hearing protection.
The OMNI Blenders are currently as of November 1, 2009 delivered as labeled: "GreatBlender / REI" - This is temporary until further notice. The blender is the same.
Privacy
The information obtained through surveys, questionnaires, and/or purchases made from participants and users or buyers is strictly kept confidential by 123Vita, LLC. The privately held information will be used, if at all, for emails to be sent to our customers / users, if so opted in, and then only with content of the 123Vita, LLC website offerings.
International Shipping
In the event any of the product offerings are sent internationally, the international shipping fee will not, or does not include custom duties and fees, import taxation, or any kind of processing fees.International shipping of blenders will in all likelihood waive the USA Warranty and for service might require that the buyer ship his/her product back to the USA. We are gladly assisting, however for a fee of $ 35.00 plus the return shipping fee to the buyer.
Returns:
Certain returns are subject to a 10% restocking fee. 123Vita, LLC reserves to notify the buyer of such applicable fee in the event of a discretionary event at the discretion of 123Vita, LLC and without prior notification. These returns are those where the customer has simply made an error of purchasing the item or has been negligent in purchasing the item in the first place, incurring a cost to 123Vita, LLC. If there is something wrong with the product, or if there is something specifically that causes the customer to be dissatisfied about the product, its quality, its workmanship, design, and/or it is different than from what has been promised, the customer may return the product without incurring the 10% restocking fee. (see OMNI Return Policy for specific information of the 30 day Money Back Guarrantee not applicable in this Return Policy)
We do not refund the initial shipping fee for the transportation to the customer, unless the error is clearly made by 123Vita, LLC. We value our customers and we will don anything in our reasonable power to remedy a problem and/or make up any error in respect to the shipping. No refunds are made on international shipping, custom duties or fees, or domestic shipping. If returned, the product must be returned, postage paid by customer. The product must be unused and undamaged and be shipped to 123Vita, LLC at 3505 E Bay Ct. Eagle Mountain, UT 84005, USA. If a damaged package arrives at our customer's location, the package is to be inspected by the buyer to see if the item itself is damaged. The postal carrier is to be notified by the recipient / buyer. The information is to be passed on to the seller, 123Vita, LLC within 24 hours so 123Vita, LLC can file the appropriate claims with the Carrier. If the item itself is undamaged, there is no reason for a claim.
If the item breaks or is in a condition were a return is warranted, deemed by 123Vita, LLC, while 123Vita, LLC disclaims its responsibilities, 123Vita LLC will assist in the return of the package back to the drop-shipper representing the applicable brand, make, good, for a factory.
Warranty claims and/or defects of the equipment are strictly to be reported to the manufacturing facility, and/or its warranty and/or repair office.
Right to Resell:
123Vita, LLC is officially a Utah registered Limited Liability Corporation with full rights to sell and resell equipment. We are authorized to sell equipment and/or related products by our vendors and distributors who are authorized by the subsequent or applicable factories to sell and trade. The information of who our distributors and vendors are is proprietary to 123Vita, LLC and is our own trade-secrete.
We have been subjected by manufacturers having to advertise certain products at a minimum pricing. However, we are permitted by them and by law to sell product for the price according to our decision since price-fixing is against the law in the USA.
According to Federal Law of the United States of America, its rights for free sale and rights of free enterprise, it is our right to buy, sell, advertise, promote, and market any products made available to us through others.
